Safety in the Manufacturing Industry

Safety is the state of being free from harm or danger of any kind. Safety is usually achieved through careful planning and the removal of all vulnerable sources of danger or any other that are prone to arise. The first step in the management of any environment to ensure that safety is achieved involves the identification of the potential sources of danger. An array of all the panic triggers is usually made and each is tackled single-handedly. Failure to identify all the potential sources of danger may cause a lot of unforeseen harm (Stellman, 1998). In any workplace, there lie very many potential causes of harm and injury. The repercussions are likely to be very serious given that many places of work usually have hordes of people going about their business and most of the times many are oblivious of any form of lurking danger. In case of any accident that may occur, the number of casualties in many places of work is likely to be very high. The effects of such accidents can however mitigated by the careful consideration of all factors by the planners and the devising of ways to deal with the accidents prior to their occurrence. Many of the hazards that may occur in most working places and cause loss of lives and damage of property includes fire, floods, chemical explosions, release of poisonous gases and the risk of being shred by machines and being cut by very sharp objects (Moi, 1993). Manufacturing Industries: Manufacturing industries are the type of industries that are involved with the production of goods for the end user markets. Such industries produce these goods in large masses; mass production, and the raw materials are brought to these industries in bulk. A lot of machines and are used in various processes within these industries and a lot of manpower is also incorporated in order to increase the production by these industries. All the processes, right from the offloading of the raw materials to the packing of the finished products involve a lot of manpower and machines and many accidents that jeopardize the workers’ safety are likely to happen in any of these stages. Different manufacturing industries usually have different strategies of ensuring their employees’ safety and reducing the occurrence of accidents. Safety in the manufacturing industries: It is mandatory for all industries to ensure that their employees are safe and are free from any kind of harm in the course of duty at these industries. There exists a set of laws that govern how al industries ensure the safety of their employees while at work in the industries. The employees are also obligated to follow the policies, procedures and the directives that are set out in these laws, to the letter. They are also expected to be on protective gear provided by the industry at all times. They are expected to adhere to all the safety rules that are laid out by their employers. The employers are on the other hand expected to give directives to their employees that would be implemented in case of any tragedy and even put signs at strategic places within these industries. The signs must be brief and clear to the employees in order to avoid any confusion whenever there is an accident of any kind (Poltev, 1986). The Passing of the Safety Act: It is estimated that about six thousand workers in the USA die every year due to workplace injuries, another fifty thousand workers die because of exposure to workplace hazards and millions of others die because of non-fatal injuries sustained at their workplaces. This was estimated to be depriving American businesses about one hundred and twenty five billion dollars per year. The government is in all ways trying to curb the occurrence of such by ensuring the safety of every employee at his or her place of work. Safety at the workplace goes a long way to see the cultivation of a good and better job culture at the place of work. The Occupational Safety and Health Act (OSHA), was passed by the congress in 1970. This act was passed in order to ensure that each and every worker in the nation of USA was working under conditions that are safe physically and even health wise. Some states, however, have enacted their own laws to protect the workers from any physical or health risks at their places of work though they also do ensure that these laws are as effective as those set in the federal law. The OSHA covers all employees except those who are self-employed and public employees in the state and local government. Responsibilities of the manufacturing industries (employer): According to the OSHA website – www. osha. gov, the Occupational Safety and Health Act stipulates that: The manufacturing industry should provide its employees with well-maintained tools and equipment. This serves to ensure that the probability of the occurrence of an accident due to the ineffectiveness of the equipment. The industry officials should ensure that faulty equipment is replaced or repaired immediately to avoid any casualties of any kind resulting from any accident. The industry should also offer the employees with appropriate protective equipment and clothing in order to protect these workers from bodily harm from the various things that they handle within a day. This facilitates the reduction of the occurrence of accidents and the effects of any hazardous substances that the employee may come in contact with. The manufacturing industries must also take their employees for medical examinations prior to and after any activity that may be involving any hazardous substances (Rabinowitz, 2002). In case of any signs of infection, the treatment and medication should be administered on the patient immediately in order to lower the chances of the employee becoming severely affected. The employees should also be granted access to their medical and exposure records. Such records should always be at their disposal so that they can be always updated about their health status and take any personal measures necessary. The industries must provide training to their employees prior to handling any equipment that may be hazardous. The training should be done as per the standards set by the OSHA. This serves to ensure that the employees are well acquainted with the type of equipment that they use for any particular task that the employer bestows upon them. This kind of training also ensures that there is a reduction in the number of accidents that occur in these industries. The standardized training also ensures that there is uniformity in the way accidents are dealt with and this avoids confusion in case of such accidents occurring abruptly. Accidents should be reported to OSHA within the first eight hours of their occurrence. Those accidents that cause lots of casualties should also be reported within this period. Accidents that leave more than three people hospitalized should also be reported to OSHA within this same period. This facilitates the investigation and evaluation into the cause of the accident and the necessary measures are taken in order to reduce such accidents in future and thus increase safety in the workplace. The employer is also obligated with the duty of posting the OSHA poster (OSHA 3165), which informs the employees of their rights and responsibilities. No discrimination is allowed upon an employee who goes forward to address some grievances to OSHA regarding the workplace. The industries are also obligated to keep records of work-related accidents, injuries, illnesses and their causes. They should also post OSHA citations and abatement verification notices to a worksite. They should also abate cited violations within the set prescribed period. The Responsibilities of the Employee: The employee should review the employer provided OSHA standards, regulations and requirements in order to be well conversant with them and follow them accordingly and report any flaws in order to avoid accidents and other mishaps. The employee should also request for information from the employer regarding emergency procedures so as to avoid confusion at the time of tragedy. The employee should observe each and every directive accordingly (Harms-Ringdahl, 2001). The employee should try and grasp the safety and health training provided by the employer as per OSHA standards. Such training should be administered in cases where some toxic substances are involved. All other procedures set for emergencies should also be carefully studied. If carefully observed and followed to the letter, these rules and regulations can spare many lives and save lots of others in the manufacturing industries (Taylor and Hegney, 2004).

A transmission from an Earth station to the satellite is referred as â€Å"Uplink†. A transmission from satellite to an Earth station is referred as â€Å"Downlink†. The component in satellite which takes an uplink and convert into downlink signals is known as â€Å"Transponder†. There are number of ways of categorizing satellite communication:-Coverage Area:It covers the global, regional and national. The larger the area of coverage, the more satellites must be involved in a single networked system.Service Type:Fixed service satellite, broadcast service satellite and mobile service satellite. General Usage:Commercial, Military, Amateur and Experimental.Protocols for Satellite Communication: The protocols for Satellite Communication are these:MPEG : It stands for Motion Picture Expert Group. It is the dominant standard used for TV encoding and transmission.IP : It stands for Internet Protocol. Arbitration

Arbitration Disclaimer: This work has been submitted by a student. This is not an example of the work produced by our Law Essay Writing Service . You can view samples of our professional work here . Arbitration INTRODUCTION The world has come to experience many changes in the way legal systems are evolving. The conventional methods of dispensing justice are being abandoned in favour of faster and more efficient methods of dispute resolution such as arbitration and mediation. The concept of arbitration has risen to prominence as a widely accepted form of dispute resolution between jurisdictions due to its many advantages and wide ranging applicability from commercial transactions to even the most simple of disputes and this can be seen in the fact that the United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards of 1958 has a total of 144 signatories. Mainly due to the cumbersome and lengthy process of litigation, many parties have opted for arbitration as a means of settling disputes due to its many advantages. This thinking behind this research is to critically evaluate the nature of arbitration and attempt to look at it as a veritable and eff icient means of alternative dispute resolution. It seeks to analyse arbitration in an introductory sense and attempt a differentiation between the recognition of an arbitral award and the enforcement of the award. It will attempt to look at the requirements under the various conventions for enforcement to be possible and then critically examine the grounds for non-enforcements under the conventions especially the New York convention of 1958. The methodology to be adopted by this research will be of a critical and comparative nature. Reviews of diverse literatures on the subject of this essay from one chapter to another will be carried out and in achieving the aim of this essay; diverse sources will be made reference to, including, international human rights instruments, legislations, case laws, books, journal articles, internet articles, general opinions and personal ideas. Particular emphasis will be placed on the New York convention of 1958 as a benchmark for comparism with other existing treaties and conventions on the subject. Chapter One will adopt an introductory approach and try to define the important issues raised in this essay especially the subject of arbitration and the essential nature of an award. It will define the term arbitration and attempt to enumerate the advantages or arbitration and why it has become so popular in regards to settlements of disputes viz a viz other methods of settlement of disputes. It will also differentiate between recognition of an award and the enforceability of an award which is very crucial to the very nature of an award. Chapter two will attempt to look at the requirements for enforcement and the available procedure in the New York convention and also attempt to do a comparative analysis between different jurisdictions to see the existing requirements for enforcement. Chapter three will focus on the major part of this work which will be the grounds for non-enforcement and recognition of an award under the New York c onvention of 1958 under Article 5(1) and Article 5(2) and other treaties. This will be considered in detail and a comparative analysis will be attempted to ascertain if this defences are strictly adhered to in certain jurisdictions.

The concept of Corporate Responsibility has been defined as 'An Essay

The concept of Corporate Responsibility has been defined as 'An umbrella term embracing theories and practices relating to how - Essay Example The society plays a very important role towards the success of a given business. The goods and services provided by a given business organization will be of value to the organization if they can be marketed within the society. The economic status of the society will determine the types of businesses that are likely to prosper in the area. The extent to which a given society reflects what is observed in the international market will influence how a given organization can adopt the international standards. Origin of corporate responsibility The market is characterized by high level of competition with the needs of customers constantly changing. Successful organizations are those that continuously monitor the changing market trends and making the adjustments as they are observed (Zadek, 2004, p.1). As a way of gaining competitive advantage, a business organization would be prompted to develop its reputation within a given society by giving back to the society (Warburton, 2004, P.2). The organization can decide to initiate charity programs aimed at social development like providing some free education scholarships or providing healthcare services to some vulnerable community (Metaxas & Tsavdaridou, 2010, p1). The views of every stakeholder in the organization need to be sought in developing these adjustment mechanisms. These are then applied towards the general development in the society. The contributions that a business organization has towards the improvement of the society have been a point of concern for the scholars, politicians and the common person in the recent years. Over a long period, ideas had been developed by businesses that suggest a need for them to contribute to the development of the society. Various organizations had opted to use their assets to improve the living standards of their employees (Blowfield, Blowfield, and Murray, 2008, p.12). These initiatives generated a mixture of views relating business to the society. It was acceptable that the businesses operated to generate profits by meeting the customer demand. However, it was noted that there would be lack of control over the amount of profit to be gained and the quality of the products given by the businesses (Blowfield, Blowfield, and Murray, 2008, p.12). Issues arose concerning the prices of goods and even the wages for the employees of an organization as to who should be responsible for setting the standards. There has also been a question as to whether the business should actually give back to the society. An attempt to derive a solution to these conflicting issues called for what we term as corporate responsibility. This involves the participation of various parties in ensuring that business activities are carried out in a manner that does not violate the rights of the individuals in the society and that it contributes to the general wellbeing of the members of the society (Taming the Corporation, 1998). The government is one such party that intervenes to enact legislations that govern procedures like wage and price establishment by the companies (Tuccille & Stone, 2003, p.6). The kind of management and leadership in the organization and specifically the roles of the leaders in the business are then important issues to be addressed. The overall responsibility of the company/organization is also considered in examining what constitutes corporate respon

The company of wolves by angela carter Essay Example | Topics and Well Written Essays - 750 words

The company of wolves by angela carter - Essay Example Their desperate reactions at the most unexpected time overpower them when not warranted in a particular situation. This goes to prove the fragile manner in which their heads and hearts react and the heavy load of atrocities inflicted on the black race stands integrated into the gene of the people of that race. For example, Dina’s erratic disposition during orientation games when she asserts that if she ever gets an opportunity to be an inanimate object, she would like to be a revolver and wipe out all mankind. That utterance fetches her ‘reward’ of a year’s worth of psychiatric counseling. In another instance, brownies are involved in hostility in a restroom between troops of black against white Girl Scouts over a supposed racial affront. Ironically, the black troop notices that the white girls were in fact, late learners, and the sarcasm is doubled when the black girls have no reservations at calling the white girls â€Å"retarded† while challenging over the term â€Å"nigger†. These incidents indicate the undercurrent of strong misunderstanding between the white and black race, and even the educated generation is unable to transcend this mental barrier of deep mistrust. The combustible younger generation of African Americans will cut loose from the mainstream discipline of the society and engulf the societal fabric like an avalanche causing enormous damage which may take time to heal and such incidents will remain as the permanent blots in the books on racial history of America. As such ZZ Packer (2004) is right in observing that â€Å"When you’ve been made to feel bad for so long, you jump at the chance to do it to others.†(p.27) But Dina’s problem is not related to only black versus white issue. Hers is a multi-dimensional diagnosis and she suffers more than one personality deficiencies and struggles with an identity crisis. She suffers from problems that are her own doings. She does not engage

Reflections Assignment Example | Topics and Well Written Essays - 1000 words

Reflections - Assignment Example Three similar examples are the three theaters namely Farnese All Antica, and Olimpico. Each of these has an architectural and classical significance that stretches beyond their historical importance and dominance. Farnese in Parma is a model for modern day designs. Being the proud owner of being the one of first few to have a proscenium arch. Even in modern day, the stage placing allows for the most suitable views from all angles and serves as an epitome for all the modern day theaters and stage constructions. Stage is being parted into two clear separations on each side of the wall, allowing for expanded visibility. The statues and paintings that are placed in parallel sideways adds to the design and architectural beauty and makes the stage look more brighter and rich. While discussing these three historic theaters, the thought should not be contained only to the historic precedence and performances being performed rather the edge being enjoyed by them with regard to the craft and semiotics and the deep readings hidden in them that are often being ignored. The seating arrangements are quite spacious and can allow for large number of spectators accommodation with sufficient spacing in between. Like any other theater the seats are arranged in an ascending pattern to allow maximum visibility. Multi floor seating spacing allow for large number of spectators accommodation as well as open preview of the entire theater and stage from every angle. A combined package of ashlar quinons, sufficiently spacious seatings, accommodative of large crowd, niches and curvospezzati. Once an open air theater, was later on modified and roofed as changes and developments kept creeping in the overall design. The internal design has space for orchestra, central stage, spacious isles; frescos are an added feature which is the master piece of Paolo Veronese. Other notable frescos and works include the contribution of Villa Barbaro and Bernardino Quadri to name a few. Statues of the

Book review for chinese whispers by Hsiao-Hung Pai Literature

Book for chinese whispers by Hsiao-Hung Pai - Literature review Example ntensity brought out the issues that the Chinese workers face each day, and how although there is a high awareness of the issues being faced by people working in the sweatshops in developing countries like India and China, however one thing which most people tend to overlook is the people who work at the local sweatshops even now operating within Britain. The author brings out in this book that there is a major issue that the Chinese migrant workers tend to face mainly due to high levels of exploitation and due to their own vulnerable nature as well. The author has very effectively explained the ill effects of globalization and has also brought out how the boom of the new Chinese economy is in a number of ways killing a number of people within the country itself. The author brings out that the strategic decisions being made by people to overcome and stop the sweatshops and child labor in other developing counties is not the only areas that need to be considered. The sweatshops within Britain are also following unruly manners of dealing with the people and to a great extent, are leaving the Chinese illegals to be living in inhumane conditions. This needs first attention and focus rather than focusing on other areas in other countries. Although the author does not express this as incorrect strategy, the author tries to explain the need to stop the Chinese exploitation in the UK. The Chinese are brought to the country illegally and are forced to work in different jobs with no breaks and made to live in inhumane conditions with no care from anyone. This the author explains is a major issue in the strategies of people trying to assist and cut down the ill – treatment of people. This is a sector of the society that needs assistance and needs to be focused upon to help the people and to ensure that the people are not exploited. The main errors here is that although the people have the work permits and are allowed to work, the policies in the United Kingdom government

Psychology Journal Article Summary Essay Example | Topics and Well Written Essays - 500 words - 1

Psychology Journal Article Summary - Essay Example They facilitated the research by getting 88 clients or respondents (66 women and 22 men) who are seeking counseling services from the US. They were given questionnaires wherein respondents are expected to give their answers. Out of their answers, the data collected will provide sufficient information regarding clients’ expectation to counseling in connection to factors like, personal commitment, facilitative conditions, counselor expertise, and nurturance. The result shows the relation between the four stages of change (pre-contemplation, contemplation, action, and maintenance) to the clients’ four expectation factors (personal commitment, facilitative conditions, counselor expertise, and nurturance.) The implication is that stage of change and expectations of clients are vital factors to assess whether the client is ready to engage in therapeutic process or not. Knowing the client’s expectations is favorable to the counselor and will be much helpful for him in order to make anticipations of any future or potential problems and difficulties that he might encounter during counseling. By then he will be able to find out where he is going to situate himself in dealing with different clients and at the end categorize, whether who of his clients would need corresponding counseling strategies. The procedural analysis applied by the university is really designed to help both those who seek for counseling and the counselors themselves. Phoenix Jones Character Analysis Essay Example for Free

Phoenix Jones Character Analysis Essay They say with age, comes wisdom. They say a tough life will build tough people. That the world, no matter how terrible it may seem or how bad things get, is only what you make of it. This has never been shown more so by Phoenix Jackson from Eudora Welty’s â€Å"A Worn Path†. Encumbered with age and poverty, Phoenix shows fortitude, cleverness, and a child-like view of the world while traveling to the city for medicine. Welty’s love of literature from her mother, and classic writing style with African American characters (Marrs) is clearly displayed in â€Å"A Warn Path†. Eudora Welty, whose life spanned most of the 20th century, represented the world of the deep American South in multiple genres. In stories, novels, and photography, the Pulitzer Prize winner was especially interested in the relationship of place to character. Her art explores the impact of place on the life of the individual depending on race, gender, and economic status, as well as the reverse influence of the individual character on environment, which is exeptionally displayed in â€Å"A Warn Path† (Marrs). In â€Å"A worn path† an elderly african-american woman, named Pheonix Jones, is up against the world on her way to town. Armed with nothing but her cane, she maneuvers through obstactle after obstacle, showing perseverence in the highest fashion through every disincentive that inhibits her journey. As such, her story depicts the Depression in the United States from the vantage point of a victim insufficiently represented in art—though a victim who, like the mythological phoenix her name evokes, resists annihilation, Phoenix transcends the abuse she experiences. This essay will explore Eudora Weltys character Phoenix Joness most exemplary traits. It will shine light on her fortitude, ingenuity, and light hearted view of the world. Provided along with Phoenixs traits is examples in which she shows each trait, with direct reference to â€Å"A worn path†. Imagine, having every bone in your body weakened with over seventy plus years of aging. You now have the bones of Phoenix Jones. Weakened, she struggles to get to town. Yet, still she keeps trecking over every obstacle thrown at her. This calls to merit her outstanding fortitude. At one point she encounters a barbed wire fence. With barbs glaring at her, hungry to put a halt to her journey, â€Å"There she had to creep and crawl, spreading her knees and stretching her fingers like a baby trying to climb the steps. But she talked loudly to herself: she could not let her dress be torn now, so late in the day, and she could not pay for having her arm or her leg sawed off if she got caught fast where she was. At last she was safe throught the fence and risen up out of the clearing,† (Welty 850). This is a fine example of her phenominal perseverance and fortitude, showing she was not only going to get through, but she refused to let that fence make even a scratch on her dress. And even before that, at the start of her journey, she already had shown her tremendous amount of determination. As she starts out on her journey she exclaims with a fiery attitude â€Å"Out of my way, all you foxes, owls, beetles, jack rabbits, coons and wild animals! Keep out from under theses feet, little bob whites. Keep the big wild hots out of my path. Dont let none of those come running my direction. I got a long way† (Welty 849-850). This shows that her mind is already set on getting to town and nothing is stopping her. These fine examples show the true, raw determination and fortitude within Pheonix Jones, showing that she may be frail, but she is anything but weak. There are few things that make true â€Å"good character†. Imagination is one of them. No one has better imagination than a child. A child sees the world as something different something better. Phoenix Jones clearly holds her inner-child within herself after all these years. After traveling a piece she decides to rest. â€Å"Up above her was a tree in a pearly cloud of mistletoe. She did not dare to close her eyes, and when a little boy brought her a plate with a slice of marble cake on it she spoke to him. â€Å"That would be exceptable,† she said† (Welty 850). Her imagination peeking forth, this shows even through her journey, she imagines a little boy giving her a slice of delicious cake, presenting that everything does not have to be serious. A little piece onward, she shows her enlightening imagination running wild again as she runs up on a menacing scarecrow that she gazes at from a distance. â€Å"Ghost,† she said sharply, â€Å"who you be the ghost of? For I have heard of nary death close by. † She found a coat inside that an emtiness, cold as ice. â€Å"You scarecrow† she said †Dance, old scare crow† she said, â€Å"while I dancing with you. † She kicked her foot over the furrow, and with mouth drawn down, shook her head once or twice in a little strutting way,† (Welty 851). Her fun loving child-like nature is highlighted through this passage, showing that she took a fear, and enlightened it when she found out it was a scarecrow, dancing with it, showing the trophy of imagination and optimism. Welty shows through Pheonix that imagination will never die, and that it is a precious tool to get over any obstacle. Further down the warn path, Phoenix is greeted by a discourteous hunter helping her up after she fell in a ditch in the wake of a nosy dog coming to investigate this strange intruder. This point is where she shows her cleverness and wit. As she is talking to the hunter, â€Å" Without warning, she had seen with her own eyes a flashing nickel fall out of the mans pocket onto the ground† (Welty 843), and she said nothing. As it continues the hunter runs off and she wittily bent over in his absence and â€Å"The yellow palm of her hand came out from the fold of her apron. Her fingers slid down and along the ground under the piece of money with the grace and care they would have in lifting an egg from under a setting hen†(Welty 843). As he later lies about having money to spare, this presents her wit, as she gained five cents from this brash traveller who has the audacity to later hold a gun to her head as a joke, which does not intimidate her, and only shows once again the fortitude previously stated in the last paragraph. As she gets to her destination, a clinic that she gets medicine from, she meets an attendant when she first walks in. She came to claim a bottle of medicine through charity for her grandson, which may just be a guise to get free medication, which in itself is a example of clever planning, the example I am using is of her interaction with the attendant. â€Å"Its Christmas time, Grandma,† said the attendant. â€Å"Could I give you a few pennies out of my purse? † â€Å"Five pennies is a nickel,† said Phoenix stiffly† â€Å"Heres a nickel,† said the attendant† (Welty 856). She persuades the attendant to give her a nickel, which in total gives her a dime, showing her witty resourcefulness. Whether she uses this ten cent for her grandson a windmill, or something else she wishes to buy, her adept skill and dexterity is presented as she uses wit and expierence to claim these precious boons. Pheonix Jones is a woman of many traits. From her perseverance to her sly inginuity, she uses all her characteristics to get through â€Å"A Warn Path†. She shows her child like perception in a way that eases the burdon of travelling. To the hills and back again seven times fold, her fortitude and will is an object of pure sovereinty over obstacles in her way and in her head. And with just a little bit of quick thinking and bamboozlement she was able to obtain a secondary reward from her journey, a skill that comes in handy throughout her life. Pheonix Jones is a pure, text book definition of strong.

Effects of Leadership in Contemporary Organization

Effects of Leadership in Contemporary Organization The practice shows that there is no any single factor that provides a greater benefit for the organization than an effective leadership. Leaders are needed in order to define goals and objectives for the organization, coordination, promote interpersonal contacts with subordinates and determine the optimal, effective solutions of various problems. Obviously, the organization with leaders can achieve all these much faster than an organization without them. Every action in the organization is associated with the manifestation of leaders power. Power is shown through the channels of power, which include: the power of coercion, influence, competence, information, official conduct, credibility, authority to award. When an individual affects the behavior of group members without the use of coercive forms of power, it is the manifestation of leadership. Leadership is important for any organization because of the need to select and nominate individuals for leadership positions, most suitable for management functions. The nature of leadership includes the persons personal qualities and the environment in which the company has its activities. A good leader should study both these issues for an effective management of the company. Leadership is a process of influence on individuals or groups of individuals to achieve the goals. Leadership is an important factor in the management of organizational management (Casimir 2006). It is a historically evolved social need of people in the organization of their joint activities. Leadership involves influence, it occurs among people, those people intentionally desire significant changes, and the changes reflect purposes shared by leaders and followers (Daft 2008). Leader is a member of organization, who has a high personal status, strong influence on the opinions and behavior of the people in the organization, and carrying out complex functions. I agree with the statement that an effective business leader is one who is well informed of the latest research which impacts upon leadership and who is also capable of applying this to their own organization within an ethical framework. As it is known, information is very important in modern business activity, it rules the world. The business leader of contemporary organization who is well informed of newest research, new technologies can lead his team and the whole organization to success. The leaders main task is not just to be aware of appropriate information and be able to apply it. His other functions are: the definition of goals and means of achieving them, coordination of team members, planning their work together, rewards and punishments, informational, controlling, representational function, etc. The process of influencing people due to the occupied position in the organization is called a formal leadership. However, the official head can not rely only on his position and the related power. The process of influence based on authority, trust, respect, skills or other resources needed by people is called informal leadership. The ideal situation for the management is a harmonious combination of the two foundations of leadership. Leadership is based on the specific needs of complex organized systems. These include the need of self-ordering and ordering the behavior of individual elements of the system to ensure its life and functional capacity. This ordering is achieved through vertical (management subordinate) and horizontal (single-level correlative connection, such as division of labor and cooperation) distribution of functions and roles, and especially the allocation of management functions and exercising its structures, which for its efficiency usually requires a hierarchical, pyramidal organization. The top management of such a pyramid is a leader (Ramsey 2004). The clarity of allocation of leadership position depends on the type of community that makes a part of the system and its relationship with the environment. In systems that are characterized by low group integration and a high degree of autonomy and freedom of the various elements and levels of the organization, functions of a leader are weak. With the increasing of the needs of the system and people in it, the functions of leadership and its structural, institutional segregation increases. In small groups, based on direct contacts of their members, the institutionalization of the leading positions can not occur. In this situation the main is the individual personality qualities, his ability to unite a group, to lead it. In big groups, the effectiveness of collective action which requires a clear functional role differentiation and specialization, as well as operational management and the rigidity of subordination, the institutionalization and formalization of (formalized) leading positions, giving them a relatively more power are required. The contemporary organization is of this type of association. It is characterized by the pursuing the certain stable goals, the realization of which requires the coherence of many people, their coordination and regulation on the basis of labor division. As a result of it, the contemporary organizations need the institutionalization of leadership that based on the positions of power goes to the forefront of management (Messeghem 2003). Analysis of the nature of leadership shows that it derives from the particular needs and requirements of people and their associations, which the leaders should meet. Leadership classically is understood as a special quality, a model of human or companys behavior, providing advanced positions (Ridder 2004). As a result, the leadership is a new model of management that can ensure the survival of the company in terms of changes. In social science model does not mean the description of natural law or law of the functioning of the company, but a certain set of ideas and beliefs. In sociology of management it is a set of representations of managers, researchers, consultants about the success or failure of organizational management. Leadership is one of the management models in modern business. Leadership as a management system should encourage the innovative behavior of employees, providing a constant creation and use of new knowledge at all levels of the organization. Thus, there are two features of this management system: providing an innovative behavior of employees; providing leaders at all levels of the organization. The leaders are those people who have eyes light up from the new ideas, who want to develop and who is interested in everything new. One of the slogans, which can be found in the literature on modern trends in business management, is: Leadership in each, resulting in the leadership of the organization (Hall 2001). Leadership implies autonomy, independence, originality. The leader must demonstrate an innovative behavior, his task is to change, improve efficiency, impact the staff, encouraging them to action. On the mechanism of the nomination, the leader may be formal and informal. In the first case, he is appointed from headship or be nominated and elected and obtain the official status of the leader. Informal leader can emerge and gain recognition in the collective of the organization because of his distinct individual, social, political, psychological and other qualities. The informal leader having the prestige and influence the behavior of people can be oppositional to a formal leader. Force and coercion under the leadership is often replaced by an incentive and inspiration. As a result, the impact of leadership approach is based on peoples acceptation of leaders demands without an explicit or direct manifestation of power. Leaders ability to influence people allows him to use the power and authority derived from his followers. In general, the leadership means that the followers accept the leader as a part of the organization only if he has proved his competence and worth. The leader gets his power from the followers, because they recognize him as a leader. To maintain his position, the leader should give the followers the opportunity to meet their needs, which can not be achieved in another way. In response, they satisfy the need in leadership in the ruling them, as well as providing the necessary support to achieve organizational goals (Kornik 2005). Leaders can have failures because of different reasons, but the success of leaders comes in many ways if they are of sufficiently similar abilities and skills. Studying the experience of many leaders shows that for the success they need the ability to create an image of the future state of the organization and bring it to the followers. Also a successful leader gives the followers the respective rights and powers to implement the vision expressed in the goal; can recognize his weaknesses and involve necessary resources. For improvement of enthusiasm and commitment, the leader may use the effective communication. Leader is a key figure in contemporary organization. But not everyone can become a leader. Here are the main three factors that are needed to become a leader of the organization in the modern world: 1. The personal desire to take a higher position and a willingness work for it; his ambition. 2. The ability to work with people. A successful leader is not always technically or economically the most trained professional. His task is to set goals and find the most suitable people to achieve them, ensuring the proper motivation. The ability to organize people to carry out their tasks is one of the most important qualities of the leader in contemporary organization. 3. The ability to assume responsibility and risk in combination with a high emotional stability. Haven taken the decision, the leader should not be sure in it. The risk is always present in the leaders work. 4. Leadership experience in rather young age (up to 35 years), when the basic behavioral patterns are formed. 5. The ability to generate and adopt new ideas that increase the efficiency of the collective. 6. The flexibility of behavior, the ability to reject erroneous strategies and adopt new solutions. 7. Good technical and commercial training, according to the specifics of the company. In the list above the fist places are taken by the personal characteristics of person, well ahead of those that are provided by education or work experience. This indicates the predominant role of psychological factors in management (Plsek 2001). Successful leaders are characterized by business features: self-confidence and the ability to take decisions in an uncertain situation, the instinctive feeling of the most important in each case, the ability to forge the right dating service, effective communication skills, advanced training and the ability to maintain poise and composure. Leaders losers are characterized by excessive softness in dealing with people, lack of theoretical and practical training, inability to succinctly and accurately articulate their thoughts, and the lack of attention to their appearance. T. Peters and R. Waterman identified eight common characteristics based on survey of 62 major successful corporations in search of effective management. For example, 8 general characteristics are: à ¢Ã¢â€š ¬Ã‚ ¢ Orientation to the energetic fast action; à ¢Ã¢â€š ¬Ã‚ ¢ Permanent contact with the consumer; autonomy of executants; à ¢Ã¢â€š ¬Ã‚ ¢ Consideration of people as the main source of growth in productivity and efficiency; à ¢Ã¢â€š ¬Ã‚ ¢ Increased focus on one (or several) key lines of business; à ¢Ã¢â€š ¬Ã‚ ¢ Restriction of activities that are familiar and known; dedication to the business; à ¢Ã¢â€š ¬Ã‚ ¢ Simple forms of management and a small number of administrative personnel; à ¢Ã¢â€š ¬Ã‚ ¢ Combination in the management of freedom in one (autonomy and entrepreneurial performers and structural units), and stiffness in the other (a few fundamental values; corporate rules and traditions, product reliability, etc.) (Woodruffe 2004). The principal functions of the leader in contemporary organization usually include: 1. Setting goals. Goals, assigned by the leader must be realistically achievable and at the same time, be prestigious and inspire the staff. 2. The distribution of tasks, organization of joint work and responsibility for its results; recruitment. 3. Controlling the joint work of all members of the team and individual activities of subordinate employees. 4. Planning and coordination of joint activities. 5. Motivation of subordinates, rewards and punishments. 6. Keeping external relations and communications within the organization. 7. Representational functions (Dunne 2010). The main difficulties in the work of leaders are with carrying out functions associated with psychosocial stress: à ¢Ã¢â€š ¬Ã‚ ¢ Leadership of subordinates; à ¢Ã¢â€š ¬Ã‚ ¢ The motivation, finding the appropriate task for everyone; à ¢Ã¢â€š ¬Ã‚ ¢ Recruiting and firing the staff; à ¢Ã¢â€š ¬Ã‚ ¢ Conflict solving in the team (Shelton 2002). The leader of contemporary organization can not always afford to be gentle and kind. In the interest of the team he must be tough, and sometimes insensitive. The most important thing in his work is to cause enthusiasm among subordinates; otherwise it is difficult to achieve high performance of the team. It is even possible to say that the product of a leaders activity is a special atmosphere in the team, forcing everyone to work more efficiently. A true leader knows how to make any work interesting and important; he can help employees realize their talents in their work. Leadership in contemporary organization consists of three components: personal characteristics, socio-professional tools, technology of leadership. The leader can not be an altruist. Selfishness of the leader is manifested in the fact that the achievement of socially significant goals is only the background to solve his personal problems. He is often aggressive; he has a unique resource of thinking, when the world around him is perceived primarily as a resource for achieving the goal. The socio-professional tools include the power and mentality (social and national peculiarities of character and worldview), education and special training. There are two directions of leaders power use: self-affirmation and self-realization. The second option is constructive. The technology of leadership in contemporary organization involves the use of any of three his styles: 1) Aggressive; 2) Informative and technological; 3) Creative (Robbins 2002). At first style, includes the formation of relations of leaders superiority over the staff. This is an effective style, but very energy-intensive. The second style of leadership involves the creation of leaders team, his closest aides. The third style of leadership requires a focus on setting goals and specific targets for their achievements. In the 1980s the subject of particular interest in the theory of management was the mechanism of leaders attraction, the so-called charisma. This phenomenon is associated with the person, who has personal qualities that evoke admiration and faith in his ability(Ritter 2002). Some experts believe that some leaders such as President Reagan and the famous manager and president of Chrysler Corporation Lee Iacocca, won success through some specific personal qualities, personal charm, attraction, even magnetism. Studies of American scientists distinguish five main factors of behavior that are typical for charismatic leaders: à ¢Ã¢â€š ¬Ã‚ ¢ focus on key issues in order to involve other people in analyzing, problem-solving and action planning; à ¢Ã¢â€š ¬Ã‚ ¢ The ability to take risks, but only based on careful calculations of the chances for success; à ¢Ã¢â€š ¬Ã‚ ¢ Skillful two-way interaction with people through the mechanisms of understanding, empathy, active listening and feedback; à ¢Ã¢â€š ¬Ã‚ ¢ Demonstration of consistency and reliability in behavior, the open expression of thoughts; à ¢Ã¢â€š ¬Ã‚ ¢ Expression of active concern for people and strengthening their self-esteem through the mechanism of involvement in the adoption and implementation of important decisions, the formation of high self-esteem and self-esteem (Zenger 1993). Talent of leadership is based on the whole complex of social and psychological qualities. An important role is played by trust and love of the group members to their leader. The credibility and trust to the leader is recognition of his high merit and competence, recognition of the need, correctness and effectiveness of his actions. This is an internal agreement with a leader to act in accordance with his plants in productivity of organization. So, in modern business world an effective leadership is not an iron or hard hand, but a high sensitivity to the needs of followers, which is manifested in the development of employees, their involvement in group activities, and assistance in achieving personal goals. Leaders play a very significant role in contemporary organizations. I agree, that an effective business leader is one who is well informed of the latest research which impacts upon leadership and who is also capable of applying this to their own organization within an ethical framework. Leaders carry out a lot of functions, such as the definition of goals and means of achieving them, coordination of team members, planning their work together, rewards and punishments, also informational, controlling, representational function, etc. The success of any organization depends on its leader. So, he is the one who sets up the goals, knows how to achieve them, how to use his human resources in the best way in order to get success. Thus, an effective leadership is a key to success of contemporary organization. Work Cited: Casimir, G., Waldman, D. A., Bartram, T., Yang, S. (Jan. 1. 2006). Literature And Human Behavior :: essays research papers

Compare and evaluate the ways in which literature on the one hand, and the human sciences on the other may help us to know and understand human behaviour. Literature has been a major part of human culture throughout human existence. It has always been used as a way of defining how humans interact with each other. Literature is defined as ‘the writings of a period, language, or country’. If ancient times are also to be considered, then myths, legends, and theatre, which passed down literary ideas, and social critiques before the time of the written word, should also be included in this definition. The plays of William Shakespeare are a perfect example of pieces of literature that are not only entertaining, literature for literature’s sake, but also provide great insight into human nature. In one form or another, literature is entrenched as an expression of the ways of humanity, and so by absorbing it, one can gain a greater understanding of human behaviour. The human sciences offer a different angle to the understanding of human behaviour as literature does. Literature gives us insight into what is going on inside people’s minds. How someone from a culture that one might not understand, thinks. Many of Shakespeare’s plays are centered around the downfall of a particular character. This downfall arises from within the character, it is the result of a tragic flaw. The human sciences on the other hand, provide information on how humans interact with each other. They often involve social studies in which experiments involving the interactions of humans are observed and recorded. If for example some human scientists performed a particular experiment with enough people, and got a similar result each time, they can conclude that a human being is likely to act in a certain way, given the situation which was in the experiment. In this way human scientists can draw conclusions as to what is a normal reaction for a person to have in a situation, and can describe traits which are almost universal to humans. These human sciences give us a knowledge of the external aspects of human behaviour, which is extremely valuable to have. If for example, a police force wanted to know whether or not a new method they had developed for deterring graffiti artists worked efficiently or not, they might perform a human science experiment, where they secretly test their method on a sample of would-be graffitists.

Ralph Waldo Emerson Essay -- People Ralph Waldo Emerson Biography Essa

Ralph Waldo Emerson Ralph Waldo Emerson was born on May 25, 1803 in Boston, Massachusetts. Early in his life, Emerson followed in the footsteps of his father and became minister, but this ended in 1832 when he felt he could no longer serve as a minister in good conscience. He experienced doubts about the Christian church and its doctrine. These reservations were temporarily alleviated by his brief association with Unitarianism, but soon Emerson became discontent with even their decidedly liberal interpretation of Christianity. After a while, however, he discovered the writings of British poet, Samuel Taylor Coleridge, and German philosopher, Immanuel Kant, and used their works to shape his own. Emerson’s wife died in 1831, an event that likely pushed him towards a path of self-discovery. At the end of 1832, Emerson left for Europe. While there, he had the opportunity to meet some of his literary idols: William Wordsworth, Samuel Taylor Coleridge, and Thomas Carlyle. These relationships would continue to inspire Emerson as he forged his unique relationship with the universe. When Emerson returned to America in 1833, he began a career as a lecturer and published his first book, the now famous, Nature. After a series of radical lectures, Emerson shifted from sometime preacher and scholar to speaker and full-time author. His work, Essays, was published in 1841. This work only added to his notoriety as a nonconformist. He continued to intermittently publish and lecture in the United States, until he embarked upon a series of lectures in Europe in 1847. Determinism Vs. Free Will Essay -- Choices, God, Determinism

Many people often wonder what influences their choices, why they do the things they do, and why the world functions the way it does. Many like to argue that people make the choices they make because things are determined by nature and nurture, no other factors. Others like to argue that people have full control over the choices they make and there are no constraining factors. In this paper I will demonstrate that determinism is false and people are not typically determined by nature and nurture to perform the evil actions they do. I will identify what determinism is, the different forms of determinism, why people find it to be true, why I find it false, and show different examples of why. I will then go on to discuss free will, the different forms of free will, and why people do things out of free will. The definition of determinism â€Å"The world is governed by (or is under the sway of) determinism if and only if, given a specified way things are at a time t, the way things go thereafter is fixed as a matter of natural law.† The root of the philosophical idea is that everything can be explained or that everything has a reason for being and being as it is and nothing else. There are also different types of determinism that people believe in. Soft, hard, and casual determinism are the three different types of determinism. Soft determinist believe that free will is compatible with determinism. They believe in determinism, but believe free will can be present. â€Å"According to this soft determinism perspective, a person’s behavior may be caused by internal psychological states that, in turn have causes, but if no immediately pressing external agent affects the behavior, the person is said to have free will,† (Ogletree&Oberle, pg.98... ...Matile Ogletree and Crystal D. The Romans considered Castor and Pollux the gods who watched over horses and the Roman horsemen known as equites (pronounced EK-wi-teez).There are many stories or so the t whollyy and numerous versions of those stories. According to the Greek poet Homer, Castor and Pollux were the tidingss of Tyndareus (pronounced tin-DAlR-ee-uhs) and Leda, the king and queen of S touch offa. For this reason, they are sometimes called the Tyndaridae (sons of Tyndareus). Another account iden tifies the tally as the sons of Leda and Zeus, from whom they received the name Dioscuri (sons of Zeus). stock-still some other legend says t palpebra Castor was the son of Leda and Tyndareusand therefore a human piece of music Pollux was the son of Zeusand therefore a god. This difference became significant later in their lives. All tales about the correspond chequer in portraying Castor as a skilled horse trainer and Pollux as an expert boxer. Inseparable, the brothers always acted together. In cardinal of the earliest myths about the twins, Castor and Pollux rescued their sister Helen after she had been kidnapped by Theseus (pronounced THEE-see-uhs), king of Attica. Helen would later gain fame as the queen whose abduction by Paris, a trojan horse prince, launched the Trojan War. The twins also go with Jason and the Argonauts on their trip in look of the Golden Fleece.During that expedition, Pollux demonstrated his boxing skills by killing the king of the Bebryces. When a wedge arose during the voyage, the Argonaut Orpheus prayed to the gods and played his harp. The storm instantly ceased and stars appeared on the heads of the twins. It is because of this myth that Castor and Pollux came to be recognized as the protectors of sailors. Another account concerns the death of Castor. According to one account, the twins wanted to marry their cousins Phoebe and Hilaria. The women, however, were already promised to two other cousins, Idas knave 212 peak ofArticleand Lynceus. Castor and Pollux carried the women away to Sparta, pursued by their male cousins. In the fight that followed, the twins succeeded in killing both Idas and Lynceus, nevertheless Castor was fatally wounded. St. Elmos fire is a natural phenomenon that occurs during certain stormy conditions conditions. It appears as a glow on the top of tall pointed objects, such as the masts of ships, and is often accompanied by a cracking noise. When stars appeared on the heads of Castor and Poll ux during the voyage ot the Argonauts, the twins became known as the protectors ot sailors. From hat time, sailors believed that St. Elmos fire was actually Castor and Pollux access to protect them during a storm. In another version of this story, the four men conducted a oxen raid together. Idas and Lynceus then well-tried to cheat Castor and Pollux out of their dole out of the catde. The twins obstinate to take the cattle themselves, but were caught as they started to sneak away. A fght broke out in which Castor, Idas, and Lynceus were all killed. This story also has several divergent endings. In one, Castors spirit went to hell on earth, the place of the dead, because he was a human.Pollux, who was a god, was so devastated at being separated from his brother that he offered to share his immortality (ability to live forever) with Castor, or to sink it up so that he could bond his brother in Hades. Taking pity on his son Pollux, Zeus say that the brothers would take turns dwelling in Hades and with the gods on Mount Olympus. On one day, Castor would be with the gods and Pollux would be in Hades on the next, the two would channelise places. In another ending, Castor remained in Hades, but Pollux was allowed to visit him every other day. Most versions of the myth say that Zeus dictated the brothers in the heavens as part of the configuration host of stars known as Gemini. Today the two brightest stars in the constellation Gemini are named Castor and Pollux. THE PARTIES1.Howard Wolowitzz eighty-seven years old, was an excellent engineer. He was a retired changeier who had served with the Canadian Army. He worked in Ontario later, and became a originaltor and a developer of lands. 2.Rajesh Koothrappalii fifty-five years old, was a leased accountant. He has abundant experiences and background intimacy just intimately the hotel line of merchandisees.ABSTRACTHoward Wolowitzz and Rajesh Koothrappalii first met in 2000. From then on, Wolowitzz and Koothrappali resolute to begin investing in the hotel occupationes to break meshwork under the suggestion of Koothrappalii as Koothrappalii was very(prenominal) beaten(prenominal) with the hotel industry. Through several coronations on the connatural projects, Howard Wolowitzz demandly believed that he and Rajesh Koothrappalii had been into a assistantship when acquiting course activities. after Koothrappalii personalizedly do some investments without Wolowitzz, Wolowitzz though t that he was betrayed by Koothrappalii and should be compensated by a portion of earnings from Koothrappalii since Koothrappalii violated the fiduciary duties towards his follower to straighten out a undercover lucre.ANALYSIS2001-2003 Invested in North EtobicokeIn 2001, Howard Wolowitzz and Rajesh Koothrappalii invested one hundred jet Canadian dollars each in a ships compevery in north Etobicoke which is an electoral district in Ontario, and both became the sh atomic number 18holders of the company. After the subdivision of the company was sold in 2003, Howard Wolowitzz and Rajesh Koothrappalii received five hundred gram Canadian dollars severally. In this spot, Howard Wolowitzz and Rajesh Koothrappalii argon non in a union, to a greater extentover both argon the suitable sh beholders of the aforesaid(prenominal) company.First of all, they never conduct a written or oral musical arrangement that ensures their union in doing any kinds of chore. Moreover, tally to the alliance Act., the coalition means dickens or more heap dominatening a common none and having the blueprint of earning derive be in a descent called coalition. The first mates in the alliance put up to sh be the uni play gamble and good in duty which they are aiming on. Each partner is fully apt(predicate) for the debt of the self-colored in their confederacy, and general partners should get actively problematic in the focus of the course. However, in call of the exposition of the federation entity, Howard Wolowitzz and Rajesh Koothrappalii did non carry on the akin avocation and non be fully liable for the debt of the firm they invested. Instead, they are the shareholders with limited liabilities, and they do non drive authorities to use up any decisions in management while investing in dividing line. Additionally, they do non share the profit earned in real. The profit they earned is based on their personal investment quite an than the sh are one. therefore, at that quantify, Howard Wolowitzz and Rajesh Koothrappalii were ii persons who individually invested in the homogeneous firm and obtained their profess profit under the suggestion of Koothrappalii.2004-2006 Invested in Mr. boast HotelIn June 2004, Rajesh Koothrappalii advised again that he and Howard Wolowitzz invested in the comparable hotel near Niagara Fall, called the Mr. amusement Hotel. This time they invested and became the shareholders of the Mr. skylark Hotel. Differently, Rajesh Koothrappalii, who was based on his excellent experience and whopledge closely the hotel industry, involved in the management and show of the hotel. As a manager, Koothrappalii was remunerated by an sum total of ten thousand Canadian dollars per month. Until the early 2006, the Mr. Sport Hotel was sold. Meanwhile, Howard Wolowitzz and Rajesh Koothrappalii received one million Canadian dollars respectively from their shares done the sales of the hotel. Although Raj esh Koothrappalii get ind into the management of the hotel and likewise invested his bang-up to the hotel, he and Howard Wolowitzz were understood non in a partnership under this modify. To make sure a partnership legitimately exists, the Nature of Partnership in the Partnership Act states a few rules wee to be followed. One of them claims that all partners who contri savee the same amount of capital to the firm should share the same responsibility of debts and wages earned. Also, they all ought to actively participate in the management, arrangement and decision qualification of the business they guide on. Nevertheless, even though Rajesh Koothrappalii involved in the management of the Mr. Sport Hotel, Howard Wolowitzz did non involve in. As exhibit above, they still did not assume the same venture and share the same profit of the business together even they did not run the same business. Obviously, their business actions violate the Nature of the Partnership which cla ims Partnership is the apprisal that subsists in the midst of persons carrying on a business in common with a view to profit. It is undoubted that at that place was no any partnership birth between Wolowitzz and Koothrappalii. The business relationship between these two persons is just that they are the shareholders of the same hotel, and Rajesh Koothrappalii is the manager of the Mr. Sport Hotel as well. We think that the Mr. Sport Hotel was run by a mountain. Rajesh Koothrappalii would be a theatre director and shareholder in this situation since he managed and invested in the Mr. Sport Hotel. Considering about the transaction of good faith, a director holds this commerce towards his shareholders for making his own best judgments to fulfill the best interests of the company. However, Rajesh Koothrappalii did not increase the loss and cost of the company when he was the director of the Mr. Sport Hotel. On the contrary, he generated the cyberspace of shareholders, and we b uttocks assume that he executed the duty of good faith towards Howard Wolowitzz and different shareholders.A a couple of(prenominal) Years Later Invested SeparatelyIn a few years later, Rajesh Koothrappalii sometimes suggested Howard Wolowitzz to invest on the same project with him sometimes he followed the investment opportunities alone without noticing Howard Wolowitzz. Those actions made Wolowitzz feel that he was betrayed and excluded by Rajesh Koothrappalii who made a secret benefit. In fact, there is still no partnership here among Howard Wolowitzz and Rajesh Koothrappalii. similarly what was illustrated above that they repeated the same actions and fell into the same circumstances no shared profits, no shared risks, no personal liability towards the full debts, no involvement in management of the business and no running of the same business. There were several onus problems appeared.More fundamentally, no written or oral accord was given to prove their business relation ship, and neither Howard Wolowitzz nor Rajesh Koothrappalii was entitled to be an agent of their partnership if the business relationship exists. When a person becomes a partner of a partnership to carrying on a business, he is entitled to sign as an agent or a representative of the consentient partnership and the other partners as well. A person, as a specify of the partnership, has an unornamented berth to sign a pressure and conducts business activities to make a profit to the partnership. The fetchs he signs and the business activities he involves in should be dish outed as an effective document. However, none of them has an probable authority when they conduct business activities outside their partnership. In other words, none of them can be considered as a ratified agent of the partnership, and they cannot make decisions on behalf of the partnership wakelessly. Moreover, without notification, no other people outside their partnership would consider them into a partne rship and treated them as legal partners in business. The public did not attain and realise that Howard Wolowitzz and Rajesh Koothrappalii are legal partners in a partnership. The absence of the apparent authority is not the only problem. To be one partner in a partnership, everyone has a responsibility to fulfill the fiduciary duties with each other. As noted in Partnership Act, partners are butt to render trustworthy accounts and full learning touching the partnership to any partner or his legal representatives. That is to say that the accurate information and accounts having influences on the partnership must(prenominal) be available to all partners. standing(a) on the Howard Wolowitzzs doom of view, Rajesh Koothrappalii concealed the information of investment opportunities of their partnership, and reserved the beneficial opportunities to himself. Furthermore, Howard Wolowitzz believed that every partner must account to the firm for any benefit derived by him without the consent of the other partners from any transaction concerning the partnership or form any use by him of the partnership property, name or business connection. Indeed, Rajesh Koothrappalii did not notice Howard Wolowitzz about some investments although he invested by himself. It is not necessary for him to inform Howard Wolowitzz since no real partnership exists between them.2011 Purchased a HotelRajesh Koothrappalii spent two million Canadian dollars on an obsolete hotel hardened on Queen Street at the business district area of Toronto and started to renovate it with his two sons. Then, he had an bargain with Triden Investment Inc. (abbreviated as TII) and allowed TII to set up residential condominiums on his place. Also, they agreed that they would divide their profits through selling the condominiums. Koothrappalii estimated that he would gain a profit of around six million Canadian dollars. The Partnership Act clarifies some elements of partnership, including having a real rel ationship between partners, carrying on a business in common and having a view to profit. At first, according to this time period of this case, it is certain that Rajesh Koothrappalii and Triden Investment Inc. had an agreement about the construction of the condominiums and his two sons Rajesh Koothrappalii entrusted TII to build the condominiums. However, they did not create any agreement about a partnership relationship between them in a written or oral manner. In addition, Koothrappalii and TII did not run a business in common. It is a fact that Koothrappalii had an ownership of property which was the hotel he purchased, but he did not manage and operate the construction. not only did TII construct the hotel, but also managed the whole process of construction. Furthermore, Koothrappalii and TII had a share of profit. Although the share of profit is a expose point of partnership, they cannot be regarded as a partnership if this point is only condition they allow in common. With t he purview of TII, Rajesh Koothrappalii and Howard Wolowitzz do not permit any partnership relationship in this construction project. Rajesh Koothrappalii individually signed an agreement with TII about the construction of condominiums without acting as a partner of the partnership with Howard Wolowitzz.TII, as an outsider from the partnership between Rajesh Koothrappalii and Howard Wolowitzz, did not acknowledge and discover the partnerships existence between Rajesh Koothrappalii and Howard Wolowitzz. Thus, it shows that Wolowitzz does not have an apparent authority of a partnership and does not make the troika party know he had a partnership with Rajesh Koothrappalii. In addition, Rajesh Koothrappalii purchased the hotel and had an agreement with TII by himself and Wolowitzz did not get involved in these procedures. Therefore, Koothrappalii and Wolowitzz do not carry on a business in common. More gravely, Koothrappalii and Wolowitzz do not share the profit of the construction. Sharing a profit between partners is an essential element in the partnership.CONCLUSIONIn terms of the above facts and analysis of this case, Rajesh Koothrappalii and Howard Wolowitzz do not have a partnership relationship. There is no adapted get to show that they acted as partners. The business expressions and actions of Koothrappalii and Wolowitzz do not correspond to the definition of the partnership. Firstly, they never make a written or oral agreement of partnership between them in each business investment from the beginning to the end. Secondly, they do not carry on one business in common. travel but not least, they do not have a share of profits and costs. In this case, their tangible business role are shareholders or investors, they do not form any typical forms of business. The master(prenominal) reason is that they undertake and invest their own business separately. Despite of considering about the partnership relationship, Koothrappalii and Wolowitzz do not have a ny partnership liabilities since they do not form a partnership. From a legal point of view, Wolowitzz is not entitled to have claims on the compensation about fiduciary duties like secret benefits from Koothrappalii. Conversely, Koothrappalii has no an obligation to compensate for Wolowitzz in fiduciary duties because they are not in a partnership. In conclusion, the partnership between Rajesh Koothrappalii and Howard Wolowitzz does not exist in this case.ADVICETo Howard Wolowitzz accord to my analysis and conclusions of this case, I suggest Howard Wolowitzz not to accomplish Rajesh Koothrappalii. The above analysis reveals that his appeal is belike to be rejected and he whitethorn abide a jurisprudencesuit because there is no any severalise to show that Rajesh Koothrappalii and Howard Wolowitzz have a partnership relationship. Wolowitzzs business actions cannot prove that he has the conditions of partnership. Thus, Koothrappalii does not have any liability of partnership to compensate for Howard Wolowitzz. Also, Wolowitzz mis recognise the concepts of partnership. He thinks that he is in a partnership but actually he is not in integrity. So Koothrappalii has no liability to him. However, there are some situations in this case Id like to have-to doe with. Initially, Koothrappalii suggested Howard Wolowitzz to invest many businesses every time.If Koothrappalii take Howard Wolowitzz to invest a business with his advice, Wolowitzz whitethorn lose a lot of money and this investment is very beneficial to Koothrappalii to earn more profit. It is apparent that he provides Howard Wolowitzz with inaccurate information in order to discover his business purpose. When this kind of situation happens, Wolowitzz can swear out Koothrappalii and he has a personnal liability to Wolowitzz because his business behavior violates the law of business defraud. Nevertheless, If Koothrappalii suggests him to invest and offer true and reliable investment information to Ho ward Wolowitzz and Wolowitzz obtains the loss of profits in his own investment, this problem volition be attributed to Wolowitzz instead of Koothrappalii. In this situation, Koothrappalii has no any liability to Wolowitzz, and he does not violate the law of business defraud as well. In addition, if the Mr. Sport Hotel is run by a corporation, Koothrappalii will be a director and shareholder of the Mr. Sport Hotel from 2004 to 2006.At that time, Howard Wolowitzz is also a shareholder of that company but not a director of the company. If Wolowitzz can find grounds that Koothrappaliis investment as a director does not give the best interests to the Mr. Sport Hotel, Howard Wolowitzz may fulfill him in fiduciary duties as a shareholder. In this situation, Rajesh Koothrappalii violates the duty of good faith. But Id like to warn Howard Wolowitzz that there is a limitation period of a contract and tort appeal which is two years. From the time of this situation to now, the time range is around six years. Thus, it is less likely to appeal successfully for Wolowitzz. An another intimacy Id like to suggest to Howard Wolowitzz is the concept of apparent partners. We know Howard Wolowitzz are not in a partnership so he cannot be tie in to the concept of apparent partners in this case. However, if he wants to establish a partnership with other people in the future, he has to pay financial aid to his apparent authority of a partnership. When he and his partners are going to integrated with the third party, he is bound to make the third party notice that he and his partners have a partnership relationship. This is one of the most significant points in the partnership. Furthermore, this case will cost Howard Wolowitzz a mint of money, verve and time. If he loses the vitrine, he will make it more costs on it since he has to fork up a part of the pull throughning partys legal fees. Howard Wolowitzz should realize that he almost has exact probability to captivate t his lawsuit so I suggest that he had fail not to carry out Rajesh Koothrappalii. It will be not good for him. snip and energy are very important to him because the opportunity cost of time and energy are earnings. He can take advantage of the time he puts on this lawsuit to invest and develop more businesses for earning profits. Eventually, Id like to recommend Howard Wolowitzz to submit and learn the statutes and laws of business in Canada via different kinds of friendly media like TV news, magazines, newspaper or Internet. These are good and convenient ways for Howard Wolowitzz to understand the business law further. He can develop his law knowledge better. He also can know various cases about business law on news. It is a good source to pay attention to many laws that he does not really know. Also, Howard Wolowitzz can search for some laws on the Internet. This method will show him about laws fast and efficiently. There are some good business laws on the website, such(prenom inal) as e-laws on Service Ontario website. Furthermore, going to program library is a nice choice to read the statutes of business law if he is interested in more business law.To the lawyer, Ms.LittigatorFrom my analysis and judgments of this case, I advise that Ms.Littigator had better not athletic supporter Howard Wolowitzz sue Rajesh Koothrappalii because the probability of losing a lawsuit for this case is very large. Firstly, it is hard for you to win a lawsuit for this case because Howard Wolowitzz and Rajesh Koothrappalii do not have a partnership legally. They just acted as shareholders to invest their business separately all the time. With the perspective of a lawyer, Ms.Littigator cannot have sufficient and strong differentiate to prove that they have a real partnership relationship. Secondly, I found that a situation may bring a benefit to Howard Wolowitzz. If the Mr. Sport Hotel is run by a corporation and Howard Wolowitzz have evidence that Rajesh Koothrappalii did not make the best interests to the corporation called the Mr.Sport Hotel rather than himself as a director, it is possible that you may help Wolowitzz sue Koothrappalii in the fiduciary duty of corporation rather than the fiduciary duty of partnership. However, the most important thing is that a limitation period of contract and tort appeal is two years. Thus, I still think that it is good for you to not help Wolowitzz sue Koothrappalii. What is more, you are more likely to lose your profit, energy and time. If you lose the lawsuit, you will not attain the remuneration from the losing party. You also lose your time and energy on it. Actually, you can use the time you put on this lawsuit to deal with a new lawsuit which you can win. Finally, if you really would like to help Howard Wolowitzz, I have another several suggestions. Howard Wolowitzz was a vet in his early life. He may not know the newest version of the business law. As he became a land developer and always carry on a busin ess by himself, Howard Wolowitzz may not have much chance to collaborate with others and form a partnership when doing business. This makes him unfamiliar with and misunderstands the meaning of a partnership, and was mistaken about the business relationships between Koothrappalii and him. To this point, since Koothrappalii and Wolowitzz have been in an acquaintanceship for a long time, they must know each other very well, and may know that Wolowitzz did not know the business law of partnership a lot. However, when Koothrappalii and Wolowitzz conducted investments, Koothrappalii did not indicate their relationships in business unequivocally to Wolowitzz and even did not mention that they are personal investors but not partners. There is a point hidden here that Koothrappalii may mislead Wolowitzz with the partnership relationship between them, and made Wolowitzz firmly believed that they are in a partnership. The key conditions including the age, a retired soldier, the familiarity with business laws and the mistake caused by a long-time friend Koothrappalii can lead Ms.Littigator and Howard Wolowitzz to a relatively advantageous position in the royal court. Unless Ms.Littigator emphasizes the characteristics of Wolowitzz that he is older, not knowing business laws so much and believed Koothrappalii but was misled by him, Ms.Littigator does not have any chance to win this lawsuit.IMPRESSION OF HOWARD WOLOWITZZHoward Wolowitzz was once an engineer and a war veteran. Thus, he did not have any business experiences in the past few years. Thats why he does not totally understand and know the business laws. In any court action, Howard Wolowitzz is a typical person who is hard to win the lawsuit. He does not have patience to essay his situations in different ways. He does something on pulsation and does not considerate about one thing carefully and comprehensively. This kind of incautious personality is more likely to lead him to make mistakes in other cases as simil ar as the case we analyze before. Also, Howard Wolowitzz is an easily angry and not tolerant person. When he thought Rajesh Koothrappalii hide him to make a secret benefit, he was very angry about Rajesh Koothrappalii and want to sue him immediately. This fact also reveals that he made decisions fast and this kind of attitude causes him to make mistakes easily. Whats more, he did something with his emotions. For example, he loves Rajesh Koothrappalii as a son. Actually, Rajesh Koothrappalii is not his son and Howard Wolowitzz did not realize that he did not have authorities to intervene with Rajesh Koothrappaliis own business. Therefore, a person has similar personalities and attitudes like Howard Wolowitzz is more likely to make mistakes in and misinterpret the law.
